According to reports from Rusternburg ,on a Wednesday The Lilongwe magistrate court ruled against the arrest of Bushiri and his Wife Mary ,reported by Malawi media
The malawian Media also stated that , the state made an application for warrant in order to arrest the couple ,this happened after the withdrawal of the appeal of that November 20 ruling , which was giving Magistrate Viva Nyimba a tough time who stated that the Bushiri's must attend the court by a way of summons not on arrest
Magistrate Nyimba ruled that no warrant if arrest should be made against the Bushiri's , for they need to appear in court upon being summoned and not arrested ,this was reported by Radio station Capital FM Malawi.
Magistrate Nyimba stated that the hearing of the extradition shall start on the 8th of March ,where the state was supposed to provide all remaining documents to the defence on the 18th January , Bushiri and his wife are wanted in S.A on Money laundering and Fraud related charges which are related to an investment scheme worth about $7 million.
The Bushiri's where arrested in south africa , soon as they where given bail ,they Quick flew to Malawi claiming that they were not safe in Mzansi , however this bail only allowed them to travel within North West and Gauteng until their case was finalized .
Magistrate Nyimba released the Bushiri's stating that they where arrested unlawfully due to the fact that there was no formal request from South Africa , However the state wanted the Bushiri's to remain in custody for 30 days whilst waiting for South Africa to make a formal request ,so that they can be returned to stand trial.
Steven Kayuni the director vof public prosecutions (DDP) ,filed an application in the high court of Lilongwe ,to appeal Nyimba's Ruling , but then withdrew the application after South Africa formally requested the extradition of the couple.
On a Wednesday Kayuni told the court that a request had been formally served on Malawi from South Africa, including charges of Fraud , theft ,forgery and failing to comply with bail conditions in South Africa.
