Government to inspect shops and restaurants for foreigners in Western Cape on this dates

The department of labor has just announced that it will be checking the restaurants and shops in Western Cape to check the legality of foreign nationals working in the industry. The mega blitz inspections will commence from the 24th to 28th January 2022 in the Metropole, Cape Winelands, and Overberg regions.

The inspectorate will be testing compliance on the Occupational Health and Safety Act (OHSA); the National Minimum Wage Act (NMWA); the Compensation for Occupational Injuries and Diseases Act (COIDA) and the Basic Conditions of Employment Act (BCEA) Unemployment Insurance Act (UIA).

The mega blitz will also serve to provide technical information and educate and support to both employers and workers about the services offered by the inspectorate. The department of Home Affairs will be working with SAPS and the Department of Labor to check the work permits of foreign nationals.

All institutions like Hotels, Restaurants, Backpackers, and Bed and Breakfast facilities will be fully inspected. Provincial Chief Inspector David Esau said companies must prepare their business and make sure that their house is in order. David said that among the documents that the department wants are:

Attendance Register. (Last 2 months); 

Information about remuneration (payslips/envelopes), overtime, leave pay (Last 2 months);

Signed employment contracts/letters of appointments of an employee. 

Unemployment Insurance, registration number, as well as proof of last payments;

A list containing the names and ID numbers of all employees are some of the records inspectors will be expecting employers to produce.

Compensation of Occupational Injuries and Diseases Act (COIDA) registration number as well as proof of last payments; 

A copy of the CIPRO Certificate
