The Draft Amendment Bill for Further Legalization of Cannabis in South Africa

South Africa: For the purpose of improving the Laws of the Country, some Acts are continuously amended to improve their affectivity.

Recently the Department of Justice and Constitutional Development amended two Acts of the Law. Those were Equality and Discrimination which appeared on Mybroadband Weekly.

Now, to further legalize cannabis, the Department of Agriculture, Land Reform and Rural Development has released a proposal aiming at commercializing marijuana for job opportunities and benefits to the economy.

The purpose include the signing of the Cannabis Act into Law within the next 2022 /2023 financial year. The proposed Act could be summarized as follows:

1. The purpose in general is to demystify issues pertaining to decriminalization and private use of cannabis

2. Buying and selling of cannabis, cannabis oil and cannabis seeds also to be made legal

3. Possession and use by cannabis users in private or public places be allowed under certain terms and conditions

4. The quantities per individual or household, in private or public places be outlined and mandated accordingly

5. The bill also aims to enhance and promote lawful utilization of the plant for the benefit of the economy and job opportunities

6. Through legal utilization, it will offset the illicit trading of marijuana and thereby benefit the Country through tax benefits as well

7. Most importantly, provision for who previously received criminal records for cannabis possession

The new Law is structured in a way to encourage commercial usage in order to promote the commercial realities involved in growing, processing and supply of cannabis.
