Gone are the days when trust funds were safe in the hands of attorneys and law firms.
Several potential beneficiaries have approached the courts as they seek their funds which will have been misappropriated by the executors and attormeys.
Anton Coetzee (pictured) and the law firm Thinane Du Toit Inc. were found to have misappropriated funds from a trust in a case brought against them in the High Court of South Africa, Gauteng Local Division, Johannesburg, case reference 2019/5503.
This was according to a report that has been published by IRS Forensic Investigations today which has left all the dirty linen exposed.
Coetzee and Thinane Du Toit Inc. sought leave to appeal at the Supreme Court of Appeal. The petition for leave to appeal was dismissed in October 2020, case reference 692/20.
Coetzee and Thinane Du Toit Inc. then approached the Constitutional Court for leave to appeal. This further and final petition for leave to appeal was dismissed in December 2020 by the Constitutional Court with reference 291/20.
A criminal case has been opened and is currently the focus of an investigation by the Hawks.
Coetzee is known to have business interests outside of South Africa in Mauritius.
