Arthur Fraser pulls a shocker on Raymond Zondo's road to becoming Chief Justice

Acting Chief Justice Raymond Zondo's hopes of becoming Mogoeng Mogoeng’s successor could be bleak if Arthur Fraser has his way.

Two weeks ago, the Presidency announced the top eight list of nominated individuals for the post of Chief Justice to replace outgoing Chief Justice Mogoeng Mogoeng. This came after an unprecedented public nomination process.The process began on 16 September 2021 when President Cyril Ramaphosa called on South Africans to nominate suitably qualified candidates for this critical position as Head of the Judiciary of South Africa. This invitation was intended to promote transparency and enable public participation. 

The eight names that qualified for nomination are as follows:

1. Judge President John Hlophe 

2. Justice Mbuyiseli Madlanga 

3. Justice Mandisa Maya 

4. Dr Wallace Amos Mgoqi 

5. Adv. Busisiwe Mkhwebane 

6. Judge President Dunstan Mlambo 

7. Adv. Alan Nelson, SC 

8. Deputy Chief Justice Raymond Zondo

On Tuesday, Former Correctional Services boss, Arthur Fraser, left many South Africans shocked when he wrote to the panel tasked with recommending candidates for the position of the Chief Justice. Fraser raised an objection against deputy chief justice, Raymond Zondo. Fraser's objection was sent through Mabuza Attorneys.

In a leaked letter that Arthur Fraser wrote, the former prison boss stated that Zondo lacks judici independence and ability to act without fear and favor, as the oath of his office demands. "Such a person cannot and should never be entrusted with the highest judicial office," Fraser wrote. Fraser is referring to how Zondo handled the State Capture Commission.

Apparently Fraser thinks Zondo's fitness and properness as a Judge revolves around allowing or disallowing people to parade stories in a Commission he once chaired. That being besides the fact that Zondo has not made any recommendation against anyone, yet, including the objector. He says Zondo's conduct in the case was deliberate and sought to protect the real culprits in capturing the state.

In my opinion, Arthur Fraser and other people are just wasting their times. Ramaphosa will appoint Zondo, if he wants Zondo regardless of what they think.
