OPINION | Bathabile Dlamini is being unfairly treated on her case, this is the reason why

Former African National Congress women’s League President Bathabile Dlamini was charged for purgery. She was expected to appear in Johannesburg Regional Court on Tuesday . In 2017 Dlamini was testifying about Social grant, she gave false evidence. The decision of charging Bathabile Dlamini was welcomed by other parties, which is Black Sash trust and The Centre for Applied Legal Studies.

This sends a message to everyone about not following the law. Former women’s League Bathabile Dlamini was suppose to make sure that Sassa had enough equipments to pay everyone who deserves it after an Cash Paymaster Services came to an end. Dlamini was suppose to disclose information in fear of being held liable. This is according to Judge Ngoepe. When Dlamini was questioned, most of the times she answered “ I don’t know", “I don’t remember”. Dlamini lied under oath. “This is a significant moment for holding public officials personally accountable for the execution of their duties and to protect the integrity of the social security system,” said the director of Black Sash Trust, Rachel Bukasa. The court case took place on the 01 of October and it was postponed to 24th of November 2021.

According to Dlamini’s lawyer, hawks were not supposed to intervene, he said these charges are about corruption not about National priority offences. “The question we are raising is: did they get involved because my client is a former minister and a politician?” asked the lawyer. “Ordinarily, perjury is dealt with in lower courts, not regional, because it is not a national priority offence and that is where our objection is,” argued Mphahlane who is a lawyer.

According to Dlamini’s lawyer, there is ulterior motive in all of this. According to him, Melusi Gigaba had charges which were similar to former president Bathabile Dlamini but the case was not investigated by hawks, when it’s Dlamini everyone wants a “piece” of her why? Former President of African National Congress Women’s League Bathabile Dlamini will be back in court in November.
