Judge Kollapen hammers Ace Magashule

Ace Magashule has dismally lost his court bid to set aside his suspension from the ruling party. The suspension is part of the ANC''S step aside resolution forcing members criminally charged to vacate their positions until they have been cleared.

Things were not looking good for Ace Magashule from the beginning of the hearing as Judge Kollapen was hammering him. Watching the ruling unfold, it was obvious from the beginning that the High Court was going to dismiss his challenge to his suspension as ANC Secretary General.

In his opening, Kollapen says rule 25.70 of the ANC cannot be struck down on the basis that it is silent on the principle of natural justice. "It cannot be said that rule 25.70 is unconstitutional," Kollapen says. Judge Jody Kollapen argued that it’s clear that Ace Magashule was afforded a proper hearing before he was suspended. The principles of natural justice were observed, he says. Suspension of Ramaphosa was in "conflict with the anc constitution"Judge kollapen maintained.

It looks like Magashule was just wasting his time and money. Gow can you challenge the same constitution of the organization that you have been applying? He must learn that when you are a member of the organization you ought to be abide by the rules of that organization.
